1. These Terms

1.1 These Terms of Use govern your use and access to our services, including our website(s), application(s), application programming interfaces (APIs), notifications, and any content appearing therein (collectively, the “Platform”).

1.2 By using our Platform, you agree to these Terms regardless of whether you are a paying user or a non-paying visitor. If you are using our Platform on behalf of an entity, you are agreeing to these Terms on behalf of that entity.

4. Availability of Our Services

4.1 We may update or discontinue any part of our Platform or services at any time. If major features are removed, we will give reasonable notice.

4.2 We may release features in testing phases (e.g. “beta” or “trial”). These are not guaranteed to be stable or available.

4.3 We reserve the right to limit your usage, suspend, or terminate your access if you breach these Terms or misuse our Platform.

4.4 We do not guarantee uninterrupted access to the Platform, as downtime may occur due to maintenance or technical issues.

4.5 You are responsible for ensuring that your devices are compatible with our Platform. We do not guarantee that the Platform is free of bugs or viruses.

5. Your Account and Security

5.1 When registering, you must provide accurate information. Use a secure password and keep it confidential.

5.2 Do not share your account credentials. Shared access may result in suspension or termination of your account.

5.3 We reserve the right to disable accounts if we detect violations or security risks.

6. Use of the Platform

6.3 This licence is revoked if you breach these Terms or any applicable conditions we impose.

7. Your Rights

7.1 You retain ownership of the content you submit. By posting content, you grant us a licence to use, copy, and distribute it as outlined in our Privacy Policy.

7.2 You are responsible for your content and its compliance with legal obligations.

7.3 You warrant that your content does not infringe on any third-party rights.

8. Our Rights

8.1 All intellectual property on the Platform belongs to us or has been licensed to us.

8.2 You may not reproduce, distribute, or modify our content without permission.

8.3 We may review and remove content that is offensive, harmful, or infringes third-party rights.

8.4 Our names, marks, and logos are our trademarks and may not be used without written consent.

9. Integrations and Credit Checks

9.1 We integrate with third-party software for additional functionality. Use of such services is subject to third-party terms.

9.2 You authorise us to request your credit report from a licensed credit bureau in Singapore, by submitting required personal data.

9.3 You authorise the credit bureau to use and disclose your data for reporting purposes.

9.4 You may request corrections to your credit report through us, supported by proper documentation.

9.5 Credit report access logs will be recorded but are not visible to external organisations.

9.6 We only use your credit data to provide our services and not for any other purpose.

9.7 You authorise Money Kinetics to collect consent on behalf of selected loan providers for credit score submissions.

10. Feedback

10.1 We welcome feedback and may use your suggestions to improve our Platform and services.

10.2 You waive any claim to compensation for the use of feedback provided.

11. Limitation of Liabilities

11.1 To the fullest extent permitted by Singapore law:

(a) We provide the Platform and services on an “as is” and “as available” basis. Your use is at your own risk.

(b) We make no warranties, express or implied, regarding the Platform’s performance, availability, or content.

(c) We are not liable for any indirect, incidental, special, consequential, or punitive damages.

(d) We are not responsible for loss of data, business opportunities, revenue, or reputation.

11.2 We do not limit liability for fraud or where such limitation is not permitted by law.

11.3 In all other cases, our liability is limited to the amount you have paid us, if any, in the last 12 months for our services.

12. Your Representation

12.1 By using our Platform, you confirm you are at least 21 years old and can legally enter into agreements.

12.2 If you are using the Platform on behalf of a company or organisation, you confirm you are authorised to accept these terms on its behalf.

13. Indemnity

13.1 You agree to indemnify and hold harmless Money Kinetics (Singapore) Pte. Ltd. and its affiliates from all liabilities, damages, claims, costs, and expenses related to:

(a) Your breach of these terms

(b) Your use of the Platform

(c) Your misrepresentation

13.2 You agree to cooperate fully in the defence or resolution of any claims relating to these matters.

14. Termination

14.1 These terms remain in effect until terminated by you or by us.

14.2 You may terminate by ceasing use of the Platform and deactivating your account.

14.3 We may suspend or terminate your access if:

(a) You breach these terms repeatedly or seriously.

(b) Your actions may cause harm to other users or the public.

(c) We are required to do so by law or government order.

(d) It is no longer commercially viable for us to provide the Platform.

14.4 We may report any unlawful activity to law enforcement.

14.5 Upon termination, clauses 11 to 18 will remain in effect.

15. Entire Agreement

15.1 These terms constitute the entire agreement between you and Money Kinetics regarding the Platform.

15.2 They supersede all prior agreements and representations.

16. Other Important Terms

16.1 We may transfer our rights and obligations to another organisation. We will notify you in such cases.

16.2 You may not transfer your rights without our written consent.

16.3 If any part of these terms is deemed unlawful, the remaining terms will still apply.

16.4 If we delay enforcing these terms, we may still do so later.

18. Governing Law and Dispute Resolution
